Civil disputes
This practice represents foreign nationals and expats in India in civil disputes, with landlords, employers, business partners, vendors, and others. Many of these clients deal with the dispute from a distance, sometimes after leaving the country, and the matter is run on their behalf without their constant presence.

Most civil disputes come down to one thing: holding someone to an agreement, or being held to one. For a foreign national in India, the other side often counts on the difficulty of pursuing a claim from abroad, or on a departure date that ends the matter in their favour.
The recurring situations are familiar. A landlord who will not return a security deposit. An employer who withholds dues or a final settlement. A business partner or vendor who does not pay or perform. A contract that has been broken and a counterparty who has gone quiet.
Each of these turns on the same three things: the documents, the timeline, and the remedy that is actually available. A claim that looks strong in conversation can be weak without the right paper trail, and a modest claim can be very recoverable with it.
The right first move is rarely the loudest. A precise legal notice often resolves a matter on its own, because it signals that the claim will be pursued properly. Where it does not, the civil courts and the relevant tribunals provide for recovery of money or possession, injunctions, and damages.
For a client who is abroad or about to leave, the practical question is how the matter can be run without them. Most of it can: through a lawyer holding authority, with documents handled remotely and appearances made by counsel.
How matters proceed
From notice to remedy
A civil matter usually moves through some of these stages.
Legal notice
A precise notice that often resolves a matter on its own.
Settlement
A negotiated resolution where terms can be agreed.
Civil suit
Proceedings for recovery or enforcement where they cannot.
Interim relief
An injunction to hold an asset or the status quo while the case runs.
Process
How it works
-
Consultation
The agreement, the correspondence, and the timeline are reviewed, and the realistic remedy and likely recovery are identified.
-
Notice or suit
A legal notice is sent where it is likely to work, and a suit is filed where it is not, with the case built on the documents.
-
Recovery and relief
Recovery, an injunction, or damages are pursued through the court, with the matter run on your behalf if you are abroad.

Common questions
Can a foreign national run a civil case in India from abroad?
Yes. Most of it can be conducted through a lawyer holding your authority, with documents handled remotely and appearances made by counsel.
My landlord will not return my deposit. Is that worth pursuing?
Often, yes. Deposit disputes are common and frequently recoverable, and a legal notice alone resolves many of them.
What is usually the first step?
A legal notice. It is precise, low in cost, and often resolves the matter before any suit is filed.
I am leaving India soon. Will that end my claim?
Not if it is set up properly. A matter can be filed and then run on your behalf after you leave, so a departure date does not hand the other side a win.
How is my position protected if a case takes time?
Through interim relief. An injunction can hold an asset, a tenancy, or the status quo in place while the matter runs, so delay does not reward the other side.
Is a legal notice always necessary?
Not always, but it is often effective on its own and is sometimes required before a suit is filed.
Start with a consultation
Bring the agreement, the correspondence, and a short account of what happened. The claim is reviewed, the remedy is identified, and the matter can be run even if you are abroad.
