When a marriage involving a foreign spouse breaks down in India, several urgent questions arrive at once: which law applies, which court has jurisdiction, and what happens to the children.

Divorce and separation between spouses of different nationalities, or between a foreign and an Indian spouse, are not always governed by a single, obvious law. Where the marriage took place, under what law, and where the parties now live all affect which court can hear the matter and on what basis.

Custody and guardianship raise the sharpest concerns. Where one parent is a foreign national, or may leave India, the fear that a child will be taken out of the country, or kept out of it, is real and time-sensitive, and the law looks to the welfare of the child rather than the nationality of the parent.

These matters are governed by personal laws and by secular statutes such as the Special Marriage Act and the Guardians and Wards Act, depending on the parties and the marriage. The aim is a lawful and durable resolution, on status, custody, and maintenance, reached with as little further harm as the situation allows.

For a foreign client, distance and discretion both matter. Much can be handled without constant presence, and the matter is kept in confidence from start to finish.

Common questions

Which court handles a divorce when the spouses are different nationalities?

That turns on residence, where and under what law the marriage took place, and the children's position. It is one of the first things settled, so you know where you stand early.

Can a foreign parent get custody of a child in India?

Yes. Custody is decided on the welfare of the child, not on the nationality of the parent.

I fear my child may be taken out of India. What can be done?

Can a foreign spouse get a divorce in India?
